Actually there is a ton of copyright material that finds it's way to the blogs. Some of it is protected by blocks that prevent wrongful access. It appears to me the paper left the door open and unlocked and was surprised when it found some content had been borrowed. Some people just don't like to share.

So in almost all the lawsuits it was third party users who gave credit to the website from which the article was taken. Ridiculous. So does that mean they are going to sue college students who use their information and give credit in their bibliographies?

Well I guess the attorneys will decide what it's worth to argue over the legalities of it...

It sounds ludicrous to me, considering they were given credit for the article. But I guess if they think it's something worth charging for, that's their perogative to protect it.

I think it's a serious stretch to think they can successfully hold a website accountable for every post made on it. Every rule is selectively enforced if it can't be completely enforced.

Maybe their subscriptions are down, so rather than cancel the people cross posting stuff, they've decided to try and sue for some settlements.

That's odd. I wonder if this is a legal test of net neutrality?

Either way, I am going to have to protect CG from any future claims. I can't afford a suit like this; nor could I afford the loss of the domain (note that they are after $75k and the give up the domain)!

What I don't understand is how they can sue when there isn't a violation for profit? Are they using generic language in their terms of agreement that pretty much says you can't use their data, period?

Who knows... I will be curious how this falls out.

In reality it is the DMCA rearing it's ugly head. The DMCA says a plantiff can sue for copyright infringement even if the infringing party was not after a profit. Legally they may be on firm ground, however it will be up to a judge to decide the merits.

What I am concerned with is the posting of a text snip.

I suspect that if someone posts the link, and the reader has to give them the click, they are ok with it. When you post the text, why go there?
