I called the dude's insurance company today, he has a valid policy, but GET THIS - He DROPPED the truck that he hit me with OFF the policy saying he sold it. I'm SCREWED!!!!! All the agent could tell me was that he'd get with my company and go from there.

Happened to me, someone without insurance hit me in, it was their fault. I turned it into my insurance company, they paid the claim, minus my deductible and then went after the guy that hit me, they call it subrogating the loss. If/when the offender pays the insurance company, you get the deductible back.

yes, but getting 'reimbursed' is not the point. I've got the coverage but need a rental, need to see the doctor and I don't have thousands to pull from my pocket. They come over here to work, they should be legal like everyone else. I"m screwed. Plus, using my coverage will make my rate increase. But, the way it is now, I will be walking and he gets off scott free and my ins will pick up the tab. Damn shame.

Unfortunately this happens way too often. ANd I can really sympathize with you. Makes you feel like you wanna take a baseball bat to their head.

I think it should be made a law that if they have no insurance and its their fault, then they give you everything they have until the debt is paid. And I am speaking of all races....if its LAW that you have insurance, and you broke it, then you should pay the piper.

That really sucks. But the only way you are going to get anything done is through your own insurance company. As far as the doctor, tell them it's from a car accident follow-up and it will be billed under the insurance policy. Any other expenses are unfortunately a civil matter and more than likely you'd have to sue him to get it back. As far as your rates going up, you're SOL. Really an unfortunate event all around.

You have to protect yourself. No one else will. The drunk who hit me had 30k state minimum liability. To date, my bills are 225k (paid). Fortunately (divine intervention), all the insurance and some extra was in place.

The other guy won't protect you, nor will the law.

Ok, here's the deal:
The truck isn't insured through Nationwide as reported. But the truck may still be insured through another agency and no one knows it yet. Nationwide is trying to get hold of the driver and owner. Until then, my insurance is picking it up as a Collision claim. Once they get the final denial letter from Nationwide that the truck is not insured with them and something stating it's not insured anywhere else, it will be changed to Uninsured Motorist claim. At which point, I'll be refunded my deductible, doctor bills and be issued a rental, and they'll turn him over to collections or go after him in court for their money back. The adjuster for my insurance will be there at 10am tomorrow to see the car. She's already been there once today.
The damage:
Obviously the hood will be replaced, the rest of the front and the back may be repairable, exhaust will need to be fixed. The left side from the back of the t-top and door has been shoved forward a little, might be frame might not, can't tell yet. It's possible that it could simply be adjustable or only the back cradle. Untill he pulls off the back bumper, that's all that can be told at this point.

I will get a copy of the police report this afternoon, and have been instructed by the PD to inform them on what I've found out about the lack of insurance so that proper action can be taken against him by law enforcement officials. No insurance here is $500 fine.

Here in IL the first ticket you get for no insurance is a "gimmee" - the court charges $50 only. But if you take the conviction, you have to get SR-22 insurance (basically for morons who are high risk) and you have to prove it to the Secretary of State every month, otherwise they suspend your license. The second no insurance ticket is $500. The third is $2500. Mandatory fines.

Should be unlawful posession and use of a deadly weapon.(The pick-up). No license, no insurance, no drive. Should be 30 days suspension of freedom on a first offense. Whine about it, another 30 days. Treat it like a DUI as a minimum. He probably doesn't have any hospital insurance either and emergency rooms can get expensive real fast if he were to ever have a slip and fall accident or something was to fall on his head. Make sure you get a judgement against him whether he can pay or not.

I'm just curiouse why the sudden scolding. I'm not typically bigotted or even use words like "the German dude" or "French chick" or "Mexican guy", but I went back through the thread and can't find a specific racial slur.

Well, no one is here to stir up racial tension, but yes, it was a mexican that hit me, he can't be found at the moment, but don't let me even begin to tell you what a black man drove by there and said to me at the scene.... I've tried to be decent in light of it all. But, like my boss put it "It's not racial if it's real..."
I don't mean to offend anyone, I just think that fair for one should be fair and legal for all.
